Amy Koch Real Estate, operated by Amy Koch in association with The Brokery (“Company,” “we,” “us,” or “our”), respects your privacy. This Privacy Policy explains what information we collect through amykoch.com and our services, how we use it, who we share it with, and the choices you have. By using the Website, you agree to the practices described here.

1. Information We Collect

a. Information You Provide

When you contact us, request a home valuation, save a property search, or fill out a form, you may share:

  • Name, email address, phone number, mailing address
  • Property address (for valuation or seller inquiries)
  • Buying or selling timeline, budget range, and neighborhood preferences
  • Any message, question, or detail you choose to include
  • If you are a Canadian buyer, your current Canadian province and any cross-border details you share

b. Information Collected Automatically

When you visit the Website, our systems and third-party tools may collect:

  • IP address, approximate location, browser type, device type, and operating system
  • Pages viewed, time on page, scroll depth, and click activity
  • Referring URLs and search terms that brought you to the site
  • Cookies and similar technologies (see Section 4)

c. Information from MLS and IDX Search

Our home search is powered by Showcase IDX and the Arizona Regional MLS (ARMLS). If you save a search, save a listing, or sign up for new-listing email alerts, Showcase IDX stores your email and search preferences on our behalf. You can unsubscribe from listing alerts at any time using the link in any alert email.

2. How We Use Your Information

We use the information we collect to:

  • Respond to inquiries and provide real estate services
  • Deliver home value reports, market updates, and listing alerts you request
  • Schedule consultations and follow up on active conversations
  • Improve the Website, our content, and our service offerings
  • Comply with legal, regulatory, and brokerage obligations

We do not sell your personal information. We do not rent or trade it to third-party marketers.

3. Communications and Consent

By submitting a form on the Website or providing your phone number, you consent to receive calls, texts, and emails from Amy Koch Real Estate about your inquiry. Standard message and data rates may apply. You can opt out of marketing communications at any time by replying STOP to any text message, clicking the unsubscribe link in any email, or contacting us at amy@amykoch.com. Opting out of marketing does not stop transactional messages tied to an active real estate transaction.

4. Cookies and Analytics

The Website uses cookies and similar technologies grouped into three categories:

  • Essential cookies keep the site functional, secure your session, and remember your form inputs. These cannot be disabled.
  • Analytics cookies (including Google Analytics) help us understand how visitors use the site, in aggregate, so we can improve it. No individual visitor is identified to us through this data.
  • Marketing cookies may be used to measure the performance of ads or remarketing campaigns. These are only set if you have engaged with our advertising.

You can disable non-essential cookies through your browser settings. Disabling cookies may limit some site features such as saved searches.

5. Third-Party Services

We rely on a small number of trusted vendors to operate the Website. Information may be processed by:

  • WP Engine (website hosting)
  • Showcase IDX (MLS search, saved searches, listing alerts)
  • Google Analytics (anonymous traffic measurement)
  • Gravity Forms (form submissions)
  • GoHighLevel (lead follow-up, email and SMS delivery, calendar scheduling)
  • The Brokery (Amy’s licensed brokerage of record)

These vendors are contractually limited to processing data only on our behalf for the purposes described above.

6. Information Sharing

We may share your information:

  • With the service providers listed in Section 5
  • With The Brokery and licensed cooperating agents when needed to deliver real estate services
  • With title companies, escrow agents, inspectors, and lenders when you are actively under contract
  • To comply with subpoenas, court orders, or other valid legal process
  • To protect the rights, property, or safety of Amy Koch Real Estate, our clients, or the public

7. Data Security

We use reasonable administrative, technical, and physical safeguards to protect personal information, including HTTPS encryption on the Website and access controls on internal systems. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Data Retention

We retain personal information for as long as needed to provide services, respond to your inquiry, comply with our legal and brokerage record-keeping obligations (typically five years for real estate transaction records under Arizona law), and resolve disputes. Inquiry-only data is generally purged after 24 months of inactivity.

9. Your Privacy Rights

Regardless of where you live, you may request to:

  • Access the personal information we hold about you
  • Correct inaccurate information
  • Delete information that is no longer required by law for us to retain
  • Opt out of marketing communications

To make a request, email amy@amykoch.com with the subject line “Privacy Request.” We will respond within 30 days. We do not sell personal information, so a “Do Not Sell or Share My Personal Information” request is honored by default.

10. Children’s Privacy

The Website is intended for adults. We do not knowingly collect personal information from anyone under 13. If you believe a child has provided us with personal information, please contact us and we will delete it.

11. International Visitors

If you are visiting the Website from outside the United States, including from Canada, please note that your information will be transferred to and processed in the United States, where data protection laws may differ from those in your home country. By using the Website, you consent to this transfer.

12. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be reflected in the “Last Updated” date above. Continued use of the Website after an update constitutes acceptance of the revised policy.
